1. Dogs NOT allowed at the farm:
• The following dog breeds are deemed “Dangerous Animal Breeds” by our insurance company and NOT allowed on premise: Pit Bulls, Rottweilers, Staffordshire Terriers, Chow, Presa Canario, Akitas, Wolf or Wolf Hybrids, Huskies, Malamutes, Mastiffs, any mix which includes any of these breeds.
• Any animal, regardless of breed, that has been involved in an injury-related event are NOT allowed.
2. Assumption of Risk: I understand my visit to Kirsch Enchanted Valley Acres, LLC whether I bring a dog myself or not, is not without risk to myself, my dog(s) (if any) and any other guests, dogs. These include, without limitation, risks of physical injury, mental injury, emotional distress, trauma, death, communicable disease, contact with other farm guests and their dogs and property damage, farm equipment and environmental hazards. All risks are known and appreciated by me. I waive any and all specific notice of the existence of the risks.
3. Dog Behavior, Rules:
I agree my dog(s):
• Are NOT any of the breed(s)/mixes of breed(s) listed in 1. Animals NOT allowed at the farm, “Dangerous Animal Breeds”.
• Have NOT been involved in an injury-related event as stated in 1. Animals NOT allowed at the farm.
• Has/Have CURRENT VACCINATIONS, including rabies as required by Wisconsin Law.
• Does NOT have fleas or other infectious/contagious conditions to other animals or humans.
• Will remain LEASHED and I will maintain FULL CONTROL of my dog(s) at all times.
• Will NOT be allowed to interact with other dogs without first asking the other dog owner/handler and receiving consent.
• Will NOT be allowed within reach of children and adults’ faces/seated on the ground.
• Will NOT be allowed near farm animals or any restricted areas marked.
• Will NOT go down the slides or on jump pads.
4. Owner Responsibility:
I accept full responsibility for:
• Any injury, damage, or loss including death caused by my dog to people, animals, property or equipment.
• Ensuring my dog’s behavior conforms with the dog behavior and rules listed above.
• Cleaning up after my dog(s) and properly disposing of waste.
5. Release of Liability:
By checking the box, I hereby waive and release Kirsch Enchanted Valley Acres, LLC, its owners (Angela and Christopher Kirsch) of any or all premises and/or it’s employees, agents of said owners from any and all damages, losses, fines, claims, suits, expenses (including attorney fees and defense costs), judgements and/or liabilities of any form or nature resulting from any act or omission of any dog or dog owner/handler visiting Kirsch Enchanted Valley Acres, LLC. This release of liability includes, but is not limited to any injury, death, sickness or personal injury or property damage my dog(s) or I or my guests may suffer while on or around the premises. This release also includes specifically, but without limitation, any and all forms of personal injury (including death) and property damage to myself, other persons and my guests, and other animals resulting from the act or omissions of any and all dogs or dog owners/handles and I expressly assume the risk of such damages or injuries and losses throughout the duration of my visit. I also agree to defend, indemnify and hold harmless Kirsch Enchanted Valley Acres, LLC and it’s owners (Angela and Christopher Kirsch), it’s employees, agents of said owners from any and all claims, suits, losses, damages, expenses (including attorney fees and defense costs), judgements, fines and penalties and or/liabilities due to any and all forms of personal injury (including death) and property damage which my pet, I or my guests may cause or be alleged to have caused, to any person, animal or property while on or around the premises.
By my signature below, I hereby state I am at least 18 years old and legally responsible for the dog(s) in my care, that I fully understand and agree to the above terms, rules and conditions in consideration for admission to Kirsch Enchanted Valley Acres, LLC.
